These Terms & Conditions ("Terms") govern your access to and use of MarketPilot AI (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility & accounts
You must be at least 16 years old and able to form a binding contract. You are responsible for keeping your credentials secure and for all activity under your account.
2. Subscriptions & billing
- Paid plans are billed in advance on a recurring basis until cancelled.
- Fees are non-refundable except where required by law.
- We may change pricing with at least 30 days' notice before the next renewal.
- Taxes may apply based on your billing location.
3. Acceptable use
You agree not to:
- Violate any law or third-party rights.
- Send spam, phishing, harassment, hate speech, or illegal content.
- Reverse engineer, scrape, or overload the Service.
- Use the Service to create competing AI training datasets.
- Bypass rate limits, security controls, or platform policies (Meta, Google, etc.).
4. Your content
You retain ownership of content you upload or generate. You grant us a worldwide, non-exclusive licence to host, process, and display your content solely to operate the Service. You are responsible for ensuring you have the rights to any content you submit.
5. AI output
AI-generated outputs may be inaccurate, incomplete, or biased. You are responsible for reviewing outputs before publishing. We make no guarantee of fitness for a particular purpose for AI outputs.
6. Third-party integrations
The Service connects to third-party platforms (Facebook, Instagram, YouTube, WhatsApp, Google Ads, payment providers, etc.). Your use of those platforms is subject to their own terms. We are not responsible for changes, downtime, or actions taken by third parties.
7. Intellectual property
The Service, including software, design, and trademarks, is owned by MarketPilot AI and its licensors. We grant you a limited, non-transferable licence to use the Service per these Terms.
8. Suspension & termination
We may suspend or terminate accounts that breach these Terms, pose security risks, or remain unpaid. You may cancel your subscription at any time from the dashboard.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
11. Indemnity
You agree to indemnify and hold us harmless from claims arising from your content, your use of the Service, or your violation of these Terms.
12. Changes to the Service or Terms
We may modify the Service or these Terms. Material changes will be communicated by email or in-app notice. Continued use constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which MarketPilot AI is established, without regard to conflict-of-law rules.
